New EB-5 regulation is undergoing final review before being published as a Final Rule. The new regulation is being heavily criticized for proposed significant increases in the investment requirement. The targeted employment area investment threshold will increase from $500,000 to $1,350,000 and the standard investment requirement will increase from $1,000,000 to $1,800,000. https://www.govinfo.gov/content/pkg/FR-2017-01-13/pdf/2017-00447.pdf . The final review is expected to take a few months. Once published, there should be a 45-60 day grace period before the new investment levels apply. It’s important if you are considering an EB-5 investment to plan ahead as demand is expected to surge to beat the increases.
