Beginning late Spring 2016, USCIS has demonstrated a nationwide trend to deny change of status from B-2 to F-1 applications, which were timely filed but because USCIS lengthy adjudications took more than 30 days beyond the foreign national’s status expiration date.
Today after our motion to reopen/reconsider arguing the Service’s abuse of discretion, USCIS approved one of such wrongful denials. This is becoming a trend for our office.
