On January 12, 2024, the U.S. Citizenship and Immigration Services announced the launch of organizational accounts for H-1B fiscal year (FY) 2025 cap season, as well as H-1B non-cap filings and associated Form I-907, premium processing requests. The launch will happen on February 20, 2024.
The organizational accounts aim to:
(1) Streamline the process for Form I-129 for Nonimmigrant H-1B workers and help reduce duplicate submission of H-1B registrations and other common errors.
(2) Allow multiple individuals within an organization of the petitioning company, and their legal representatives to collaborate on and prepare H-1B registrations.
(3) Electronic filing will now be available for Form I-129 for H-1B petitions and Form I-907 premium processing requests.
(4) Overall enhance customer experience with the new and improved design, efficient process flows and case management features for account holders.
Filing for the H-1B Cap Registration for FY 2025 is still a two-step process, involving (1) electronic registration where petitioners seeking to file H-1B cap-subject petitions, must first register electronically during the designated registration period as assigned by USCIS, and pay a $10 non-refundable fee for each H-1B registration. If selected from the lottery, then, (2) the petitioners can file the actual H-1B petition within the period provided, which is usually 60 days.
Another important feature of the H-1B cap random selection is the reversal of the order of the regular and advanced-degree lotteries. Initially, the regular lottery was conducted first, followed by the advanced-degree lottery. The recent change now prioritizes the selection of beneficiaries with advanced degrees, potentially increasing the chances for those with higher qualifications.
These developments come as part of broader efforts to reform the H-1B visa program and ensure it meets the evolving economic needs of the U.S. economy. As stakeholders navigate these changes, staying informed about the latest updates and adhering to the revised procedures is crucial for a successful H-1B Cap Registration process.
